Terms and Conditions

  1. Definitions:
    1. “The Client” refers to you, the customer in question.
    2. “The Photographer” refers to me, Will Fuller Photography.
    3. “The Images’ refer to any images supplied by Will Fuller Photography to you The Client in either print or electronic form.
  2. General:
    1. Signing of this document and payment of the booking fee will be considered acceptance of the Terms and Conditions by The Client.
  3. Copyright:
    1. Any images or copies of The Images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. Ownership of the Copyright is retained by The Photographer.
  4. Distribution:
    1. The Photographer retains irrevocable and unrestricted use of The Images for editorial, trade, advertising, literature, competitions, and any other purposes required. 
    2. Digital and print copies of The Images can be sold on to friends and family of The Client by The Photographer. The Client is still able to send digital copies to friends and family if they wish.
    3. The Images will never be sold for a profit by The Photographer to any other third parties (excluding friends and family of The Client) without prior written consent of The Client.
    4. The Images may be sent to third party vendors who also worked at The Clients event, for their marketing use. This will be done and agreed by The Photographer. If The Client does not wish for The Images to be shared with third party vendors who worked at their event then The Client must agree this in writing with The Photographer before the time of booking.
  5. Royalty Free Licence:
    1. All clients receiving images are granted a Royalty Free Licence with them, allowing The Clients rights to print and distribute The Images as they see fit.
    2. Restrictions still apply on all commercial uses of The Images. Therefore, it is prohibited for The Images to be used by other suppliers and businesses without prior written consent of The Photographer as stated in point 4.4.
  6. Payments & Booking Fee:
    1. A booking fee is required to secure The Client’s event date. No dates will be secured until this fee has been paid.
    2. The Client has a 14 day cooling off period after paying the booking fee, where they can choose to cancel for a full refund. After this 14 days there will be no refund of the booking fee.
    3. The full balance is owed 28 days before the date of the event. The Photographer reserves the right to not be present at the event unless the full payment has been completed before the date of the event.
    4. Additional printed goods ordered must be paid in full at the time of ordering.
  7. Limitation of Liability:
    1. If the extremely rare situation arises where The Photographer is unable to attend the event due to unforeseen circumstances all possible efforts will be made to find a suitable replacement in The Photographers absence.
    2. If no suitable replacement is found for The Photographer then a full refund will be made to The Client, including the cost of the booking fee. 
    3. In the very unlikely event of a total photographic failure on behalf of The Photographer where no images can possibly be supplied to The Client, a full refund will be made to The Client, including the cost of the booking fee.
    4. Liability shall be limited to the total value of the contract between The Client and The Photographer.
  8. Force Majeure / Act Of God:
    1. The contents of this contract shall be contingent upon Acts of God such as Floods, Fire, Warfare, and any other situation beyond the control of either The Photographer or The Client.
    2. In the event of an Act of God, neither party shall be held liable.
  9. Cancellations:
    1. Cancellations by The Client within 14 days of the booking fee being paid will be due a refund of their booking fee.
    2. Cancellations by The Client after 14 days of booking will be owed no return of the booking fee.
    3. Cancellations within 100 days of the event will mean The Client owes the full cost of their photography coverage to The Photographer.
    4. Cancellations by The Photographer will mean a full refund including booking fee back to The Client.
    5. If The Client wishes to change the date of the event they are able to do so if The Photographer has the date still available. If The Photographer does not have the date available then a cancellation by The Client will be issued, taking into considerations the usual terms and conditions of a cancellation.
  10. Coverage & Artistic Licence:
    1. Artistic licence will be granted to The Photographer at the event. The Photographer cannot be held responsible for any specific artistic tastes of The Clients.
    2. The Client accepts that the editing style of The Images will be similar to that already represented within The Photographer’s portfolio.
    3. The Photographer cannot guarantee any one image of an individual, or any specific pose.
    4. There may be differences in colours in the final edited images. This can be due to lighting on the day. The Photographer cannot guarantee any colour matching.
    5. Editing will be in the form of basic colour, contrast and exposure corrections. Any retouching required will be at an additional cost that will need to be requested by The Client.
  11. Event Exclusivity:
    1. The Client grants The Photographer exclusivity to photograph their event as their sole professional photographer.
    2. If any other professional photographers are present at the event then The Photographer cannot guarantee any specific quality of The Images.
    3. The Clients guests have unlimited access to take any photographs that they wish to.
    4. The Photographer is happy to work alongside any videographers that The Client may also want to hire to capture the event. In this situation The Photographer cannot guarantee that the videography team will not be visible in The Images.
  12. House Rules:
    1. The Photographers is limited by the guidelines and rules set in place by the ceremony official or the reception venue site manager. The Client accepts that any restrictions set in place may affect the quality of The Images, and it is their responsibility to negotiate with the ceremony officials or reception venue site managers if they do require certain images to be taken.
  13. Guest Conduct:
    1. The Photographer will not tolerate any verbal of physical abuse by The Client or any of their guests. If The Client is unable to control the conduct of their guests which results in an unacceptable degree of misconduct, or damage to photography equipment of The Photographer, it will result in the immediate departure of The Photographer. In this event The Client accepts that no refunds will be granted.
  14. Personal Accident:
    1. The Photographer may give photographic directions to The Clients or their guests on the day of the event. These directions are deemed to be at said persons own risk. The Photographer accepts no responsibility and cannot be held liable for any personal accidents.
  15. Third Party Printing & Displaying:
    1. The Images are all edited on a highly calibrated professional monitor. The Photographer accepts no responsibility for how The Images may appear when printed by any Third Parties, or how they may appear on any non-calibrated digital displays.
  16. Special Requests:
    1. The Client is able to make special requests. They are welcome to offer changes to the Terms and Conditions listed here, however these changes must be agreed in writing by The Client and The Photographer before the booking is placed.
    2. The Photographer reserves the right to deny any Terms and Condition changes before or after the booking fee has been paid by The Clients.
    3. If any individual at the event does not wish to be photographed for any reason (armed forces, secret service, a person of interest to the public eye, etc) then this must be stated to The Photographer by The Client before the day of the event.
  17. Confidentiality:
    1. No personal information of The Client will ever be shared with any Third Parties. The Clients first names, location of wedding venue and The Images may be shared by The Photographer for his marketing and advertising, and they may also be used by other third party businesses working at The Clients event as stated in point 4.4.
    2. Third Party Wedding Blogs may wish to use The Images. If this is the case then more information from The Client may be requested to be shared. The Client has the right to deny extra information being shared. Nothing will ever be given to Third Party Wedding Blogs unless it is agreed in writing by The Clients.
  18. Complaints:
    1. In the unlikely event that The Client wishes to make a complaint it must be made in writing within 21 days of receiving The Images. In extreme cases a mediator may be brought in to help rectify any problems.
